New Requirement in Italy: Financial Guarantee Now Mandatory for Non-EU Companies

Since 13 June 2025, a new regulatory obligation has come into force in Italy for companies established outside the European Union (excluding the United Kingdom and Norway). These entities are now required to provide a financial guarantee to the Italian tax authorities in order to carry out intra-Community transactions.

This guarantee may take one of the following forms:

 A bank guarantee issued by an Italian credit institution;

 Government-backed securities.

Without this financial guarantee, affected companies will not have their Italian VAT number validated in the VIES (VAT Information Exchange System). Consequently, they will be unable to carry out intra-Community acquisitions or supplies.

It is also important to recall that such companies remain obliged to appoint a fiscal representative in Italy, as already required by Italian VAT legislation for the management of their local VAT registration.


Non-EU businesses active in the European market should therefore ensure compliance to avoid any disruption to their trade activities.
