Understanding the New Super Modulation and Penalties regarding Waste Electrical and Electronic Equipment (WEEE)

Since 1 January 2025, the AGEC law has imposed new regulations to encourage the eco-design of electrical and electronic equipment (EEE). 

A super modulation system now introduces incentives and penalties based on various environmental criteria.


Criteria for Household EEE

Incentive or penalty:

  • Battery separability

Criteria leading to a penalty:

  • Presence of HFC gases (for washing machines and dishwashers)
  • Use of brominated flame retardants in plastic parts > 25g (excluding cables and electronic boards)
  • Single-use equipment

Criteria qualifying for an incentive:

  • Good repairability index
  • Use of recycled plastic materials

Why this Change?

The objective is to encourage manufacturers to design more durable, repairable, and recyclable equipment.

Criteria qualifying for an incentive:

  • Absence of brominated flame retardants in plastic parts > 25g
  • Availability of spare parts
  • Use of recycled plastic materials
  • Good repairability index
